General Terms & Conditions of Sale & Attendance

These General Terms and Conditions (“Terms”) govern the purchase of tickets and admission to events organized by Carlitos Comedy Club (“Organizer”, “we”, “us”, or “our”). By purchasing a ticket or attending an event, you (“Attendee”, “Buyer”, or “you”) agree to be bound by these Terms.

2. Scope & Conclusion of Contract

These Terms apply to all ticket orders placed via our website or authorized ticketing partners.

By completing the checkout process and clicking the button confirming your purchase (e.g., “Pay Now” or “Complete Purchase”), you submit a binding offer to purchase the selected ticket(s).

The contract is concluded when we issue a confirmation email containing your order confirmation or digital ticket(s).

Tickets are issued as digital files (e-tickets/QR codes) delivered via email.

Free registrations are also a binding booking: by completing a free registration you submit a binding offer, and these Terms apply in full even though no payment is taken.

3. Pricing and Payment

All prices displayed on our website are inclusive of statutory Value Added Tax (VAT) where applicable and clearly state any applicable processing or payment service fees prior to order completion.

Payment must be made using the available payment methods at checkout (e.g., credit/debit card, SEPA transfer, etc.). Tickets will not be dispatched until payment has been confirmed.

Pricing errors: If a ticket is offered at an obviously incorrect price (including zero), we may cancel the affected order and refund the full amount paid; we will notify you as soon as possible.

Subscriber discounts: Discounts offered to signed-in customers with an active newsletter subscription (such as 5% off) are conditional on an active subscription at the time of purchase, apply only where explicitly stated, and cannot be combined with other discounts or promotional offers.

4. Statutory Right of Withdrawal (Cooling-Off Period)

Exception under Luxembourg and EU Law: Under Article L. 222-9 (7°) of the Luxembourg Consumer Code (Code de la consommation) and Article 16(l) of Directive 2011/83/EU, the statutory 14-day right of withdrawal for distance contracts does not apply to contracts regarding leisure activities provided on a specific date or during a specific period.

Accordingly, all ticket sales for dated events are final and cannot be withdrawn or canceled by the consumer once the purchase is complete, subject to the conditions set out in Section 5.

5. Cancellations, Postponement, and Refunds

Event Cancellation: If the event is canceled entirely by the Organizer and not rescheduled, ticket holders will be entitled to a refund of the total transaction amount paid, including booking, platform, service, and payment-processing fees.

Event Postponement: If an event is postponed or rescheduled, your ticket remains valid for the revised date. If you cannot attend the rescheduled date, you may request a refund by notifying us within 14 days of the postponement announcement.

Attendee Non-Attendance: No refunds or credits will be issued if you fail to attend the event, arrive late, or are denied entry due to non-compliance with venue rules or safety requirements.

Program & Lineup Changes: Event lineups, performers, and running orders are subject to change without notice. The replacement of individual performers or changes to the running order do not constitute an event cancellation or substantial alteration, and do not entitle the ticket holder to a refund or exchange.

Accidental duplicate orders: If you accidentally purchase the same ticket twice, contact us at carlitos@carlitoscomedy.club within 24 hours of the order and we will refund the duplicate in full.

6. Ticket Use, Resale, and Transfers

Each ticket admits one person unless explicitly stated otherwise.

Reproduction, unauthorized duplication, or alteration of tickets is strictly prohibited.

Resale: Commercial resale or touting of tickets is prohibited. Personal transfers to friends or family are permitted provided no markup above face value is charged, and provided the new holder agrees to these Terms. If personalized tickets are required, name changes must be requested via carlitos@carlitoscomedy.club no later than 48 hours prior to the event.

7. Admission, Age Restrictions, and Event Conduct

Ticket & QR Code: Online registration and presentation of a ticket or reservation QR code are required at the entrance. Nobody comes in without presenting a valid QR code.

Age Requirements: Admission may be subject to age restrictions shown for each event. Valid photo ID may be required at the entrance.

Right of Admission Reserved: The Organizer and venue management reserve the right to refuse entry or eject any person whose conduct is disorderly, aggressive, or poses a threat to safety, without entitlement to a refund.

Prohibited Items: Hazardous materials, weapons, professional recording equipment (without prior press accreditation), and illegal substances are strictly prohibited.

Audience Conduct & Filming: Flash photography, continuous audio or video recording of the performance, and persistent heckling or verbal disruption of performers are strictly prohibited. The Organizer reserves the right to eject any attendee who disrupts the show or records performers without authorization, with no entitlement to a refund.

8. Photography, Audio, and Video Recordings

By attending the event, you acknowledge that photography, audio, and video recording may take place for documentation, promotional, or reporting purposes.

If you do not wish to appear in promotional materials, please inform staff or photographer at the event entrance or contact carlitos@carlitoscomedy.club.

9. Liability

The Organizer is not liable for loss, theft, or damage to personal belongings brought onto the event premises, except where caused intentionally or by gross negligence.

10. Data Protection

Personal data collected in connection with ticket sales and event attendance (such as name and email address) is processed strictly in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR). 11. Dispute Resolution, Consumer Mediation & Governing Law

Governing Law & Jurisdiction: These Terms are governed by the laws of the Grand Duchy of Luxembourg, without prejudice to any mandatory statutory consumer protections under the laws of your EU country of habitual residence. In the event of a dispute, the courts of Luxembourg City shall have jurisdiction, subject to mandatory rules permitting consumers to bring actions before the courts of their place of domicile.
